Acceptable Use Policy (AUP)
5.1 Customer is exclusively responsible for any commercial transactions involving the Dedicated Hosting Services and for the use by End-Users thereof, including all commercial transactions between Customer and End-Users, whether completed or not.
5.2 Customer warrants that it will take all necessary measures to protect the access code and password, provided by Dedigate, and to avoid that the access code and password become known to, or are in any way used by unauthorized persons. Customer shall remain exclusively responsible for any communication, established by means of the above access code and password.
5.3 The following provisions, also referred to as "the Acceptable Use Policy", have the purpose to ensure a responsible use of the Internet and its resources and to avoid practices which degrade the usability of the Network.
These provisions compose a policy for a use of the systems and the Network that is considered to be acceptable. The overall principle: Customer may only use the Network for lawful purposes. The use of the Network or Dedigate systems in violation of any Belgian, Dutch or international legislation or regulation is prohibited. This includes, but is not limited to, transmission of copyrighted material without consent of the copyright owner, material legally judged to be threatening or obscene and material protected by trade secret, whether or not Customer was aware of the content of the material or of the relevant law. Dedigate reserves the right to immediately remove any material or data and to block the use of the Network by Customer when its use or purpose does not meet this Acceptable Use Policy.
Dedigate will not communicate its customers’ e-mail addresses or other personal identification to any third party without prior written approval. Exceptions are made within the scope of judicial investigations to which Dedigate will fully cooperate.
